During any construction project, preventing soil erosion and sediment entering waterways is essential. Maine has state laws and delegated authority from the EPA to regulate construction runoff. The Department of Environmental Protection’s (DEP) Bureau of Land Resources (BLR) issues permits for most construction projects disturbing one or more acres, conducts compliance inspections, and works to bring non-compliant sites into compliance. The BLR’s experience with large construction projects, particularly ground-mounted solar arrays, is discussed, along with efforts to improve the permitting process and minimize non-compliance. A technical guidance document has been developed, outlining additional requirements for large construction projects to prevent erosion and sedimentation. These requirements are based on inspections, third-party reports, and approved permits. The document will undergo a public comment period before being finalized.
